Mark Washington Real Estate has filed a writ at an Accra High Court demanding specific performance for breach of contract.
The house cost US$ 270,000 and the former Hearts of Oak is alleged to have made a deposit of US$ 155,000.
But Tagoe has denied owing Mark Washington Markuviah and claims it is rather the owner who owes him.
"It's not the truth when I came back from overseas Mr. Washington said he has used the two bedroom house and is planning on building the a six bedroom house and a piece of land by the house they had sold to him,” Tagoe said.
“And I told him to refund my initial deposit of $155000 I gave him because I didn't have money to buy the three bedroom house as I earlier promised and he agreed to. Am surprised he has taken to media claiming I owe and even dragged me to court"
The former Accra Hearts of Oak striker returned to Saudi Arabia after a six months spell with Ettifaq before moving to Bundesliga side Hoffenheim, where he failed to shine.
He later played in the Serbian league scoring 12 goal and moved on to the Turkish league where he struggled to find the net. Tagoe recently has put pen to paper on a short-term deal with an Israeli second tier side Hapoel Bnei Lod.
